Terms of Service

Welcome to AIBA. These Terms of Service ("Terms") govern your access to and use of the AIBA application, websites, content, products, and services (collectively, the "Service") provided by AIBA Technologies ("AIBA," "we," "us," or "our"). Please read these Terms carefully.
1. Agreement to Terms
By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a binding legal agreement between you and AIBA.
2. The AIBA Service
2.1. Eligibility: You must be at least 13 years of age to use the Service. By agreeing to these Terms, you represent and warrant to us that you are at least 13 years old.
2.2. Account Registration: To access the full features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are solely responsible for safeguarding your account password and for all activities that occur under your account.
2.3. Guest Use: We may make certain features of the Service available to non-registered users ("Guests"). Guest use is subject to a daily usage quota, which we may change at any time. To prevent abuse, we may use technical measures to track Guest usage.
2.4. Subscriptions: Certain features of the Service may be subject to payment ("Premium Services"). By selecting a Premium Service, you agree to pay the applicable fees. All fees are non-refundable, except as required by law. We may change the fees for any Premium Service upon thirty (30) days' notice to you.
3. User Content
3.1. Your Content: You retain full ownership of all data, information, and content you submit to the Service, including conversation transcripts, contacts, notes, and external API keys ("User Content").
3.2. License Grant to AIBA: To operate the Service, you grant AIBA a limited, non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, modify, and process your User Content solely for the purpose of providing and improving the Service for you. This license ends when you delete your User Content or your account.
4. Acceptable Use Policy
You agree not to do any of the following:
- Use the Service for any illegal or unauthorized purpose or engage in, encourage, or promote any activity that violates these Terms.
- Use the voice chat feature to record individuals without their consent, in violation of applicable privacy and wiretapping laws.
- Attempt to reverse engineer, decompile, or discover the source code of the Service.
- Circumvent any technological measure implemented by AIBA or any of our providers to protect the Service.
5. Third-Party Services
The Service may permit you to connect to third-party services or APIs (e.g., by providing your own API key for an external AI model). When you use a third-party service, you are subject to their terms and privacy policies. AIBA does not control and is not liable for any third-party services. You irrevocably waive any claim against AIBA with respect to such third-party services.
6. Termination
We may terminate or suspend your access to the Service, at our sole discretion, at any time and without notice to you, for any reason, including if you violate these Terms. You may cancel your account at any time by contacting us.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND. WE EXPLICITLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, OR NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE, INCLUDING AI-GENERATED RESPONSES, WILL BE ACCURATE, RELIABLE, OR ERROR-FREE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIBA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.
9. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of California. Any dispute arising from these Terms shall be resolved through binding arbitration in San Francisco, California, except as otherwise required by applicable law.
